Sometimes, conservation is better for the community and nearby land is just as suitable—or better—for development. Conservation easements are one of the most effective tools for keeping forests intact while allowing families to build a legacy and enjoy their land.

By permanently limiting future development, conservation easements provide confidence that the climate benefits of protecting the forest will last well beyond the life of the carbon project.

2. What a conservation easement is

A conservation easement (also called a conservation agreement or conservation restriction in some states) is a voluntary legal agreement between a landowner and a qualified conservation organization, such as a land trust. The agreement permanently limits certain types of development to protect the land's natural, agricultural, or conservation values.

3. How easements are valued

Conservation easements are valued using a "before and after" appraisal. A qualified appraiser estimates the property's fair market value before the easement based on its highest and best use (its maximum legal and economic potential), then estimates its value after the easement restricts certain development rights.

The difference between these two values is the conservation easement value:

Unrestricted Property Value − Restricted Property Value = Conservation Easement Value

For example, if a property is worth $1,000,000 without a conservation easement and $600,000 after the easement is recorded, the conservation easement is valued at $400,000. Because a conservation easement limits future subdivision or development, the property's market value is lower after the easement is in place. The difference in value represents the easement itself.

5. Bargain sales, donations, and tax considerations

Charitable or Bargain Sale. Most commonly, landowners do a bargain sale for their conservation easement, which is a mix of selling and donating. The landowner receives payment for part of the easement's value and donates the remaining value.

For example, if an easement is valued at $500,000 and the landowner is paid $300,000 for the conservation easement, the remaining $200,000 is considered a donation. Step 3. Option Agreement. If both parties decide to move forward, they sign an option agreement. This gives the land trust time to complete due diligence, secure funding, and prepare the conservation easement while the landowner agrees not to sell or develop the property during that time.

Step 4. Due Diligence. The land trust completes the work needed to finalize the project, which may include an appraisal, title review, survey, baseline documentation, and drafting the conservation easement.
